Last updated: [30/12/2025]

These Terms & Conditions (“Terms”) govern your access to and use of the website Birdwatching Sardinia (the “Website”) and any services, content, bookings, or purchases made through the Website. By accessing or using the Website, you agree to be bound by these Terms.

1) Company Information

The Website is operated by:

2) Scope of Services

The Website may allow you to:

  • View informational content about birdwatching experiences at the Foce del Coghinas (Sardinia) and related activities;
  • Request information or contact us;
  • Book guided tours/experiences and related services where available (the “Services”).

Specific details (itinerary, duration, inclusions, requirements, meeting point) are shown on the relevant pages and/or in the booking flow and form part of these Terms.

3) Eligibility

By using the Website and/or booking Services, you confirm that:

  • You are at least 18 years old, or you are using the Website under the supervision of a parent/guardian;
  • You have the legal capacity to enter into a binding agreement.

Minors may participate in tours only if accompanied by a parent/guardian or as part of an organized group with responsible adults, unless otherwise stated for a specific activity.

4) Bookings and Contract Formation

A booking request becomes binding only when:

  • You complete the booking process (or submit a booking request), and
  • We confirm the booking by email or other written confirmation.

We reserve the right to refuse or cancel bookings where necessary (e.g., safety reasons, incorrect pricing, suspected fraud, capacity limits).

5) Prices, Payments, and Invoicing

Prices are displayed in [EUROS] and may include or exclude taxes depending on what is stated at checkout. Payment methods available will be shown during checkout.

If you require an invoice, please request it during the booking process and provide the necessary billing data.

6) Cancellations, Changes, and Refunds

Cancellation and change conditions may vary by tour type, season, and group size. The applicable policy will be shown:

  • During the booking process and/or
  • In your booking confirmation email.

Unless otherwise stated, any administrative fees, payment processing fees, or non-refundable components (if applicable) will be disclosed before payment.

7) Weather, Safety, and Operational Changes

Birdwatching is a nature-based activity. Sightings are never guaranteed, as wildlife behavior depends on season, weather, and natural conditions.

For safety and quality reasons, we may:

  • Adjust routes, timing, or content of an experience;
  • Postpone, suspend, or cancel an experience due to weather, sea/river conditions, safety alerts, or force majeure.

If an activity is canceled by us, we will offer—where applicable and subject to the specific booking policy—an alternative date, a voucher/credit, or a refund.

8) Participant Responsibilities

Participants must:

  • Follow guide instructions and safety briefings at all times;
  • Arrive on time at the agreed meeting point;
  • Wear appropriate clothing/footwear and bring any recommended items (e.g., water, sun protection);
  • Behave respectfully towards wildlife, habitats, and other participants.

We may refuse participation or remove a participant without refund if their behavior creates risk, disruption, or violates instructions.

9) Health, Accessibility, and Risk Acknowledgment

You are responsible for assessing whether you are fit to participate. Please inform us in advance of:

  • Relevant health conditions, mobility needs, allergies, or other accessibility considerations.

Nature activities may involve uneven terrain, sun exposure, insects, and proximity to water. By participating, you acknowledge these inherent risks and agree to take reasonable care.

10) Liability

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential losses (e.g., lost profits, missed connections, travel costs not included in the booking).
  • We are not liable for delays or cancellations caused by events outside our reasonable control (force majeure), including extreme weather, public authority restrictions, or natural events.

Nothing in these Terms excludes or limits liability where it cannot be excluded under applicable law (e.g., gross negligence, willful misconduct, mandatory consumer rights).

11) Website Use and Acceptable Conduct

You agree not to:

  • Use the Website unlawfully or to transmit harmful code;
  • Attempt unauthorized access to systems or data;
  • Copy, scrape, or exploit content for commercial purposes without permission.

We may suspend access if we reasonably believe there is misuse.

13) Third-Party Links and Services

The Website may include links to third-party websites or services (e.g., maps, social media, payment providers). We are not responsible for third-party content, policies, or availability. Your use of third-party services is subject to their terms.

14) Privacy and Cookies

Personal data processing is described in our Privacy Policy and Cookie Policy (where applicable). By using the Website, you acknowledge that you have read those policies.

15) Consumer Information

If you are a consumer, you may have mandatory rights under applicable law. Where relevant, please note that certain consumer withdrawal rights may not apply to leisure services provided on a specific date or within a specific period, to the extent permitted by applicable law.
